A Settlement has been reached in a class action lawsuit against ketamine therapy provider Choose Your Horizon, Inc. (“CYH”). The class action lawsuit involves whether CYH disclosed its customers’ confidential information to third parties, which is alleged to violate California privacy law.

While CYH believes that its practices were in compliance with California law and CYH believes it has implemented changes to its websites and disclosures addressing the conduct alleged in the Action, CYH chose to settle this case, without admitting liability, to focus time, effort and resources on continuing to provide valued treatment services to its patients, and not on additional legal fees and the uncertainty of litigation.

You are included if you are a California resident who, from May 9, 2023, to and through July 11, 2024, may have had your personally identifiable information or protected health information disclosed to third party entities, as a result of using the Defendant’s website, chooseketamine.com and/or chooseyourhorizon.com, while located in California.

Those included in the Settlement will be eligible to receive a pro rata (meaning equal) portion of the Settlement Fund, which Class Counsel anticipates to be approximately $337.00.

Your legal rights are affected whether you act, or don’t act.

Summary of Your Legal Rights and Options in this Settlement

Do Nothing

You will receive a pro rata share of the Settlement benefits – estimated to be approximately $337.00 – and will give up your rights to sue the Defendant about the claims in this case.

Exclude Yourself

You will receive no benefits, but you will retain any rights you currently have to sue the Defendant about the claims in this case.
