1. Acceptance of Terms

By accessing or using Ink MCP ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Ink MCP provides a deployment platform that enables AI coding agents to deploy applications via the Model Context Protocol (MCP). The Service includes application hosting, build pipelines, domain management, and related tools.

3. Account Registration

You must authenticate with a valid account (e.g., via Google or GitHub) to use the Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Deploy applications that violate any applicable laws or regulations
  • Host malware, phishing sites, or other malicious content
  • Engage in cryptocurrency mining or other resource-abusive activities
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent usage limits or access controls
  • Resell or redistribute the Service without authorization

Prohibited Content

The following types of applications and content are strictly prohibited on the platform. Violations will result in immediate termination of your account and deployments:

  • VPN, proxy, and anonymization services — including any form of traffic tunneling, relay, or network circumvention tools such as VPN servers, Xray, Tor exit nodes, public proxies, P2P relay nodes, IRC bouncers, or equivalent anonymization technologies
  • Mirrors and userbots — automated bots, scrapers, account automation tools, or mirror/clone sites of other services
  • Cryptocurrency miners — any software that uses platform resources for mining, farming, or plotting cryptocurrency, or any other blockchain computation
  • DMCA-protected content — distribution of copyrighted material without authorization, including pirated software, media, or other intellectual property
  • Torrent aggregators — torrent indexing sites, trackers, or any service that facilitates the distribution of pirated content
  • Any illegal activity — any application or content that facilitates, promotes, or engages in activity that is illegal under applicable law
  • DDoS tools and network attacks — botnets, stress testers, packet flooders, or any software designed to disrupt or overwhelm external services or networks
  • Spam and bulk messaging — email spam relays, SMS gateways, social media spam bots, or any unsolicited bulk communication tools
  • Phishing and impersonation — sites designed to deceive users into revealing credentials, financial information, or personal data, including fake login pages and lookalike domains
  • Malware distribution and C2 servers — command-and-control infrastructure, malware hosting, exploit kits, or any software used to compromise remote systems
  • Port scanning and reconnaissance — unauthorized network scanning, vulnerability scanners, credential brute-forcing tools, or penetration testing tools targeting third-party systems
  • Adult and pornographic content — hosting, distributing, or streaming sexually explicit material of any kind
  • Gambling — online casinos, sports betting platforms, lottery sites, or any other gambling or wagering services
  • Extremist content and hate speech — content advocating terrorism, violence, or hatred against individuals or groups based on race, ethnicity, religion, gender, or any other protected characteristic
  • IP spoofing and network manipulation — use of fake source IPs, MAC address spoofing, or any technique to falsify network identity or circumvent network security controls
  • Open mail relays — operating open SMTP relays or any system that can be exploited to send unsolicited email or amplify network attacks
  • Cardsharing and stream piracy — CCCam, IPTV piracy, or any service that shares or redistributes paid broadcast or streaming content without authorization
  • Traffic exchange and SEO manipulation — traffic exchange platforms (e.g. Hitleap, Jingling), Black Hat SEO tools, click fraud, or artificial traffic generation services
  • Game bots and cheating tools — video game bots, aimbots, automation scripts, or any software designed to gain unfair advantages in online games

5. Content and Deployments

You retain ownership of all code and content you deploy through the Service. You are solely responsible for the content of your deployments and ensuring they comply with applicable laws. We reserve the right to remove deployments that violate these terms.

6. Abuse and Fair Use

You agree not to abuse the Service or use it in a manner that degrades performance or availability for other users. Abuse includes, but is not limited to:

  • Creating multiple accounts to bypass limits or evade enforcement actions
  • Exploiting free tiers, trials, or promotional offers through fraudulent means
  • Generating excessive load or consuming disproportionate resources
  • Automating account creation or API usage beyond intended limits
  • Reverse engineering, scraping, or extracting data from the Service
  • Interfering with the security or integrity of the platform

We reserve the right to throttle, suspend, or terminate accounts engaged in abusive behavior without prior notice. Repeated or severe abuse may result in permanent bans. For full details, see our Fair Use Policy.

7. API Keys and Access

API keys issued to you are confidential. You are responsible for safeguarding your API keys and must not share them publicly. We reserve the right to revoke API keys that are compromised or misused.

8. Service Availability and Modifications

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue features of the Service at any time. We will provide reasonable notice of material changes when possible.

9. Billing and Payment

Certain features of the Service may require payment ("Paid Services"). By subscribing to Paid Services, you agree to pay all applicable fees as described on our pricing page. Fees are billed in advance on a recurring basis (monthly or annually) unless otherwise stated.

  • We use third-party payment processors (e.g., Stripe) to handle billing. Your use of payment services is subject to the processor's terms and privacy policy.
  • You must provide accurate and complete billing information and promptly update it if it changes.
  • Paid Services automatically renew at the end of each billing period unless you cancel before the renewal date.
  • If payment fails, we may suspend or downgrade your account until payment is resolved.
  • All fees are non-refundable except as expressly stated in these terms or as required by applicable law.
  • We reserve the right to change pricing with reasonable notice. Continued use after a price change constitutes acceptance of the new pricing.

Free tiers, trials, and promotional credits have no cash value, are non-transferable, and expire upon account termination. You are responsible for all taxes associated with your use of the Service.

10. Warranty Disclaimer

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Ink MCP does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by law, Ink MCP and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, profits, goodwill, or business interruption, arising from your use of or inability to use the Service. In no event shall Ink MCP's total aggregate liability exceed the greater of (a) the amounts paid by you to Ink MCP in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).

12. Indemnification

You agree to indemnify, defend, and hold harmless Ink MCP and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your deployments or content; (c) your violation of these terms; or (d) your violation of any rights of a third party. We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense.

13. Termination

We may suspend or terminate your access to the Service at any time for violations of these terms. You may terminate your account at any time. Upon termination, your deployments will be deactivated and associated data will be deleted in accordance with our Privacy Policy. No refunds will be issued for any fees already paid, including in cases of suspension or termination. Provisions that by their nature should survive termination shall survive, including but not limited to ownership, warranty disclaimers, indemnification, limitation of liability, and dispute resolution.

14. Dispute Resolution and Arbitration

You and Ink MCP agree to resolve any disputes arising out of or relating to these terms or the Service through binding individual arbitration, rather than in court. Arbitration shall be conducted under the rules of a recognized arbitration body in the jurisdiction specified below.

  • No class actions — You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration.
  • Waiver of jury trial — Both you and Ink MCP waive any right to a jury trial in connection with any dispute arising under these terms.
  • Informal resolution first — Before initiating arbitration, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
  • Small claims exception — Either party may bring qualifying claims in small claims court as an alternative to arbitration.

15. Governing Law and Jurisdiction

These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the federal or state courts located in the State of Delaware, and you consent to the personal jurisdiction of such courts.

16. Assignment

You may not assign or transfer these terms or your rights under them without our prior written consent. Ink MCP may assign or transfer these terms and its rights and obligations without restriction.

17. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. We will notify you of material changes by posting the updated terms on this page and, where practicable, by email or in-app notification. If you do not agree with the updated terms, you must stop using the Service.
