Speakapp Terms of Service

These Terms govern your use of Speakapp, a Web3 messaging platform with end-to-end encryption, EVM identities, and user sovereignty.

Introduction

Speakapp is a next-generation messaging and collaboration platform built on Web3 principles.

By using our services, you agree to the terms outlined below. If you do not agree, please discontinue use immediately.

1. Purpose

Purpose of Speakapp

The purpose of Speakapp is to facilitate private and secure communication without capturing or sharing unnecessary metadata. It is designed for individuals, communities, businesses, and organizations that value anonymity, privacy, and digital sovereignty. Speakapp uses Ethereum Virtual Machine (EVM) compatible addresses or cryptographic key pairs as your primary identifier instead of phone numbers or emails.

2. Private

What Do We Mean by "Private"?

Speakapp does not require you to provide any personally identifiable information. You can use the service without linking your real-world identity to an account. We do not attempt to collect user data or build profiles based on your usage.

No phone number, email address, or personal identifier is required to register or use Speakapp. Privacy and anonymity are foundational to how Speakapp is designed and operated.

3. Secure

What Do We Mean by "Secure"?

All communications on Speakapp are encrypted using end-to-end and zero-knowledge encryption. Only the intended recipient can decrypt the message. Our end-to-end encryption is implemented using the Signal Protocol.

  • Messages are encrypted on your device before transmission.
  • Encrypted content remains inaccessible to any third party, including Speakapp developers.
  • No readable (plaintext) messages are stored or transmitted.
  • While we use advanced security protocols, we cannot guarantee protection against all future threats or decryption techniques.
  • All notifications, including alerts or warnings, are also end-to-end encrypted and can only be read on your device.
3.1 Abuse

Reporting Abuse

Speakapp provides a feature to report abuse or violations of our Terms, especially in public Communities or shared content visible to others. When you report abuse, we may collect limited metadata such as group or channel identifiers, timestamps, and the type of violation reported. However, we do not access private message content due to our strict implementation of end-to-end encryption.

Reports are reviewed in accordance with our governance policies. Speakapp remains committed to privacy while ensuring that public spaces remain safe and respectful for all users.

3.2 Message Forwarding as Signed Proof

As part of our abuse reporting mechanism, Speakapp supports a method where users may forward encrypted messages they received as evidence of abuse or terms violation. This method preserves user privacy while enabling report verification. It works as follows:

  • The reported message is cryptographically signed and forwarded by the reporting user.
  • Only the encrypted payload, message ID, sender's public key, and timestamp are submitted to the report system.
  • Speakapp verifies the authenticity of the message using cryptographic proof, without accessing its decrypted content.

This mechanism enables a tamper-resistant, privacy-preserving approach to handling abuse in encrypted environments. This method ensures end-to-end encryption is fully respected while still allowing users to support abuse claims with verifiable message evidence.

4. Web3

Web3 Principles

Speakapp is founded on the principles of Web3:

  • User Sovereignty: You own and control your keys and identity.
  • Decentralization: No central authority stores or manages your personal data.
  • Authentication: You may authenticate using cryptographic signatures.
  • Privacy by design: Speakapp does not use third-party tracking services and aims to minimise and avoid long-term logging of metadata.
5. Responsibility

Your Responsibilities and Rights

5.1 Account Management and General Use

Software and account – You are responsible for keeping your device, Speakapp, and your account up-to-date, safe, and secure, including any passwords, keys, or recovery phrases.

Fees and taxes – You are responsible for data and mobile carrier fees and taxes, and any other costs, expenses, or charges associated with the devices on which you use our Services and your use of such Services.

Terms and policies – You must use our Services according to these Terms and our policies. If we block your account for a breach of our Terms, you will not create another account without our permission.

Legal and acceptable use – You agree to use our Services only for lawful, authorised, and acceptable purposes. You will not use (or assist others in using) our Services in ways that:

  • violate or infringe the rights of Speakapp, our users, or others, including privacy, publicity, intellectual property, or other rights;
  • involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, and auto-dialing;
  • breach these Terms and Conditions or the Speakapp Content Policy described further below.

Harm to Speakapp – You must not (and must not assist others to) access, use, modify, distribute, transfer, or exploit our Services in unauthorised manners, or in ways that harm Speakapp, our Services, or systems. For example:

  • gain or try to gain unauthorised access to our Services or systems;
  • disrupt the integrity or performance of our Services;
  • create accounts through unauthorized or automated means;
  • collect information about other Speakapp users in any unauthorised manner;
  • sell, rent, or charge for our Services without our written permission.

Third-party services – Our Services may allow you to interact with third-party websites, apps, and services. Their terms and privacy policies govern your use of those services.

Communities by Speakapp – You may use Communities run by Speakapp in accordance with these Terms and the specific rules of the Community.

Your content – You own and take responsibility for the content you submit (text, images, audio, video). Speakapp cannot access your private content unless you explicitly send it to us or publish it in a public space such as a Community.

Speakapp's rights – Speakapp owns all intellectual property rights related to our Services. You may not use these rights without written permission. To report infringement, email [email protected].

5.2 Speakapp Content Policy

Speakapp is committed to building private and secure technology that respects privacy, upholds human rights, and supports democratic and media freedom principles. To uphold this mission, the following actions are a breach of our Terms:

Violent Behaviour, Extremism, and Terrorism

Speakapp cannot be used:

  • to glorify violence, or promote any violence (physical, psychological, sexual) against others;
  • to incite harm or threaten others based on race, ethnicity, gender, religion, disability, or disease;
  • by individuals or groups designated by the United Nations as terrorists.

Child Sexual Exploitation

Speakapp cannot be used to organize, promote, store, or share any form of child sexual exploitation. Specifically, it must not be used to store or share:

  • sexual images or depictions of minors;
  • realistic illustrations or computer-generated sexual content involving minors;
  • sexualized comments about or directed at minors;
  • links to child sexual abuse material;
  • fantasies or advertisements related to child exploitation or trafficking.

Extremely Violent or Graphic Content

Speakapp must not be used to store or share violent or gory content that is meant to shock, harm, or disturb others.

Harmful and/or Unlawful Content

Speakapp must not be used for cyber abuse, non-consensual intimate image sharing, or distribution of abhorrent violent content, or any other unlawful activities under applicable law.

6. Monitoring

Monitoring Speakapp Breaches

Our Services are built with a privacy-by-design approach, which means that we cannot access, analyze, or monitor the private content you create and store on Speakapp, nor can we share such private content with other users or third parties.

However, Communities on Speakapp are public by nature, and the content shared there can be monitored. While we do not have the capacity to monitor all Communities, we may monitor and, where necessary, moderate Communities created and managed by us.

7. Third-party Notices

Third-party Notification of Breaches

We may receive notifications from third parties about potential violations of these Terms. Any evidence provided will be reviewed by our team or a trusted service provider to evaluate the severity of the breach and determine appropriate actions. All decisions made by our governance board are final.

Where appropriate, notifications, information requests, or takedown notices may be recorded in our Transparency Report, which we aim to update periodically.

All notifications sent to users via Speakapp are end-to-end encrypted and can only be decrypted and read on the recipient's device. This ensures that any alerts or moderation outcomes remain confidential and are not accessible to any intermediary, including Speakapp itself.

8. Release

User Responsibility, Release, and Indemnity

You are solely responsible for your use of Speakapp and all content you transmit, upload, or share through the Service, including compliance with all applicable local, national, and international laws. Speakapp does not endorse, support, or facilitate any illegal activities.

You agree that Speakapp is not responsible for, and you will not hold Speakapp liable for, any misuse of the Service, any unlawful acts, or any consequences arising from your actions or from other users' actions.

To the maximum extent permitted by law, you release Speakapp, its affiliates, officers, directors, employees, and agents from any claims, demands, disputes, losses, liabilities, or expenses (including legal fees) arising out of or relating to:

  • your violation of these Terms;
  • your misuse of the Services;
  • any content you provide; or
  • any claims by third parties related to your use of Speakapp, even if such claims arise after your account is closed or these Terms are terminated.

You agree to indemnify and hold harmless Speakapp from any such claims, to the extent permitted by applicable law.

9. Liability

Disclaimers and Limitation of Liability

9.1 Disclaimers

YOU USE OUR SERVICES AT YOUR OWN RISK. WE PROVIDE SPEAKAPP "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR FREEDOM FROM HARMFUL CODE.

We do not guarantee that our Services will be secure, uninterrupted, or error-free, nor that any information provided through the Services is complete, accurate, or reliable. We are not responsible for how or when users access or use Speakapp, nor for the content or behaviour of any users or third parties.

Because of end-to-end and zero-knowledge encryption, Speakapp cannot access or decrypt your private communications, and therefore cannot be responsible for their content or any consequences arising from them.

9.2 Limitation of Liability

To the fullest extent permitted by law, Speakapp and its developers, affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses arising out of or related to these Terms or your use of the Services, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any and all claims arising out of or relating to these Terms or the Services is limited to one hundred U.S. dollars (USD $100). In some jurisdictions, certain limitations do not apply; in such cases, our liability will be limited to the maximum extent permitted by applicable law.

10. Security

Security Protocol

Speakapp implements modern security practices, including:

  • End-to-end encryption of messages and attachments.
  • Zero-knowledge infrastructure – we cannot read what you send, even if we wanted to.
  • Network-layer protection (such as VPN or WireGuard-like tunneling) to obfuscate your IP address and encrypt media traffic, so your identity and approximate location remain private and protected.
  • No persistent logs, no tracking, and no centralized profiling of users.
11. Limitations

Service Limitations

Speakapp is not designed to interact with traditional phone, SMS, or email systems.

Speakapp does not support communication with public emergency services such as police, fire, or medical departments. You must use alternative means to contact emergency services.

12. IP

Intellectual Property

The Speakapp name, logo, software, and infrastructure are protected under applicable copyright and intellectual property laws. You may not copy, modify, reverse engineer, or redistribute any part of the platform without explicit written permission.

13. Jurisdiction

Jurisdiction and Legal Framework

Speakapp is a globally accessible, decentralized system and is not tied to a single national jurisdiction. However, you are responsible for complying with local laws applicable in your country or region when using Speakapp.

Where required by mandatory local law, disputes arising out of these Terms may be subject to the jurisdiction of the courts or arbitration forums specified by such law.

14. Changes

Updates to Terms

These Terms and Conditions may be updated from time to time. It is your responsibility to review them periodically. Continued use of Speakapp after changes become effective indicates acceptance of the latest version.
