When you use Table22, you trust us with your personal data and we are committed to keeping that trust. As outlined in the “Terms of Service”, Table22 provides Customers with unique patronage opportunities for favorite restaurants and food or beverage stores (“Merchant(s)”) through a subscription (“Subscription”) to, or purchase of, Merchant goods and/or services (“Merchant Offerings”) on the Site. In addition, Table22 may connect you with independent third-party contractors who provide delivery services (“Contractors”) for your services.

This Table22 Inc. (“Table22,” “we”, “us” or “our”)  Privacy Policy is effective as of 03/10/2023 and it describes how information is collected, used and shared when you visit or make a purchase from Table22.com (the “Service”).

1.Personal information we collect

See list below for more information on what Personal Information we may collect and why.

Information you provide to us. When you use our Service we may collect certain personal information that  you may provide to us (for example, the information you are prompted to fill out about yourself by the account registration form “Registration Data”)

• Contact data, such as your first and last name, email address, mailing addresses, and phone number.
• Demographic data, such as your city, state, country of residence, postal code, and date of birth (if you provide this information at checkout for alcohol sales)
• Profile data, such as the username that you may set to establish an online account on the Service, preferences, and any other information that you add to your account profile. We do not store or have access to customer passwords.
• Communications that we exchange with you, including when you contact us for customer service, via email, SMS or otherwise.
• Marketing data, such as your preferences for receiving our marketing communications and details about your engagement with them.
• Subscription data, such as details, descriptions, and other information about your subscriptions
• Other data not specifically listed here, which we will use as described in this Privacy Policy or as otherwise disclosed at the time of collection.
• Payment information needed to complete transactions, including payment card information. We never store or have access to raw customer credit card information in our system and use a PCI compliant payment gateway to accept and store all credit card information (Stripe)

Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Service, our communications and other online services, such as:

• Device data, such as  browser type, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), and general location information such as city, state or geographic area.
• Online activity data, such as pages or screens you viewed, how long you spent on a page or screen, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.

Cookies and similar technologies. Some of the automatic collection described above is facilitated by the following technologies:

• Cookies, which are small text files that websites store on user devices and that allow web servers to record users’ web browsing activities and remember their submissions, preferences, and login status as they navigate a site.
• Web beacons, also known as pixel tags or clear GIFs, which are used to demonstrate that a webpage or email was accessed or opened, or that certain content was viewed or clicked.

Data about others. We may offer features that help users to send “Subscription” as a gift through the Service to your contacts, and we may collect contact details about these individuals so we can fulfill their orders.  Please do not gift the “Service” to someone or share their contact details with us unless you have their permission to do so.

Minor’s Information. Our Services are not intended for children under 18 years of age, and we do not knowingly collect personal information from minors under the age of 18.  If we become aware that personal information we collected is associated with a minor under 18 years of age, we will delete that personal information. Alcohol Disclaimer. To purchase alcoholic beverages from Merchants on the Site, you must be, and hereby warrant that you are, over the age of twenty-one (21) as described in the Terms of Service.

2.How we use your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

To provide the Services: We may use your personal information to provide you with the Services

• establish and maintain your user profile on the Service;
• operate and improve the Service
• process your payment information and provide you with invoices and/or other subscription order confirmations

To Communicate with You: We may use your information to communicate with you. For example, we may send you text messages or other notifications about the status of your order.

• communicate with you via email or SMS about the Service, including by sending scheduling communications, updates regarding delivery, pickup or shipping to fulfill your subscription orders with Merchants
• provide customer support and respond to your direct requests, questions and feedback.
• keep you up to date on changes to your subscription, new products, and offers.

Marketing and advertising. We, our service providers and our third-party advertising partners may collect and use your personal information for marketing and advertising purposes:

• Direct marketing. We may send you direct marketing communications. You may opt-out of our marketing communications as described in the Opt-out of marketing section below.
• Interest-based advertising. Our third-party advertising partners may use cookies and similar technologies to collect information about your interaction (including the data described in the automatic data collection section above) with the Service and use that information to provide you with targeted advertisements or marketing communications that we believe will interest you. This is called interest-based advertising (including retargeting).

Cookies and similar technologies. In addition to the other uses included in this section, we may use the Cookies and similar technologies described above for the following purposes:

• Technical operation. To allow the technical operation of the Service, such as by remembering your selections and preferences as you navigate the site, and whether you are logged in when you visit password protected areas of the Service.
• Functionality. To enhance the performance and functionality of our services.
• Analytics. To help us understand user activity on the Service, including which pages are most and least visited and how visitors move around the Service, as well as user interactions with our emails.

3.How we share your personal information

We do not sell, rent or otherwise transfer for profit any customer information to any third parties. We may share certain customer information and details about your purchases to the following third parties in order to facilitate fulfillment of your subscription orders, as otherwise described in this Privacy Policy or at the time of collection.

Merchants and Contractors. We provide Merchants that sell items listed on the Table22 Site with information required to fulfill your subscription orders and other information about your subscription history.  To help complete your requested deliveries, we provide Contractors with the information required to provide this service, including limited personal information and order details.

Third Party Service providers. Third parties that provide services on our behalf or help us operate the Service or our business (such as hosting, information technology, customer support, email delivery, marketing, and website analytics).

Payment processors. Any payment card information you use to make a purchase on the Service is collected and processed directly by our payment processors, such as Stripe. We do not store or have access to raw member credit card information in our system (even temporarily) and use a PCI compliant payment gateway to accept and store all credit card information (Stripe). Stripe may use your payment data in accordance with its privacy policy, https://stripe.com/privacy.

Advertising partners. Third-party advertising companies for the interest-based advertising purposes described above.

We make commercially reasonable efforts to verify that the parties with whom our application shares personal information provide a level of protection of personal information consistent with the practices described in this Privacy Policy, except that all such parties described above other than service providers and affiliates may, to the extent permitted by law, use personal information as described in their own privacy policies.

4.Your choices

Access or update your information. If you have registered for an account with us through the Service, you may review and update certain account information by logging into the account at app.table22.com. Opt-out of marketing communications. You may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us by emailing us at [email protected].  Please note that if you choose to opt-out of marketing-related emails, you may continue to receive service-related and other non-marketing emails. Advertising choices. You can limit use of your information for interest-based advertising by:

• Browser settings. Blocking third-party cookies in your browser settings. Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser controls, often found in your browser’s “Tools” or “Preferences” menu. • Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising:\

Some Internet browsers may be configured to send “Do Not Track” signals to the online services that you visit. Please note that because there is no consistent industry understanding of how to respond to “Do Not Track” signals, we do not alter our data collection and usage practices when we detect such a signal from your browser. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services. Delete your content or close your account. 5.Security

Security. Table22 will use industry standard efforts to maintain the confidentiality of your Registration Data and Customer Content. Although Table22 will implement and follow measures to protect against unauthorized access to or interception of your Customer Content, you acknowledge and agree that Table22 cannot fully eliminate security risks and cannot guarantee that unauthorized access to your information will never occur. You acknowledge and agree that Table22 may disclose information about you or your use of the Services if compelled by law to do so, or if such action is deemed by Table22 as reasonably necessary to (a) comply with any applicable laws rules or regulations; (b) comply with any legal process; (c) enforce these Terms; (d) respond to claims that such information violates a third party’s rights; or (e) protect the interests of Table22 or others.

6.Information Retention

To preserve the integrity of our databases, standard procedure calls for us to retain information submitted by members for an indefinite length of time. Table22 understands your submissions as consent to store all your information in one place for this indefinite length of time, if we so wish. We will respond to written member requests at [email protected] to erase all non-essential and public information and terminate account access.

7.Changes to this Privacy Policy

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Service or other appropriate means. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Service after the effective date of any modified Privacy Policy indicates your acceptance of the modified Privacy Policy.
