EULA - End User License Agreement

End-User License Agreement for Viperbyte, a product of NetPlay Software.

All copyrights to Viperbyte are exclusively owned by NetPlay Software.

The term 'Viperbyte' refers to both the registered and unregistered versions of the software unless otherwise specified.

Viperbyte is distributed "AS IS" and you (the "Licensee") assume full responsibility for determining the suitability of Viperbyte and any results obtained.

The unregistered version of Viperbyte, marked as "Viperbyte Lite", may be freely distributed in its original format. No person or company may charge a fee for the distribution of Viperbyte without written permission from NetPlay Software.

NetPlay Software grants to you as an individual, a non-transferable, nonexclusive license to Viperbyte as follows:

PERSONAL - Usage is restricted to non-commercial purposes only.

Licensee may not remove or alter any copyright, trademark or other proprietary notice contained in Viperbyte. Further, you may not use Viperbyte for any purpose that is infringing, illegal, or defamatory in nature.

NetPlay Software and the authors of Viperbyte make no warranty that all errors have been or can be eliminated from the complete Viperbyte software package and, with respect thereto, NetPlay Software and the authors of Viperbyte shall not be responsible for losses, damages, costs, or expenses of any kind resulting from using or misusing Viperbyte including without limitation, any liability for business expenses, machine downtime, damages experienced by you or any third person as a result of any deficiency, defect, bug, error or malfunction. NetPlay Software and the authors of Viperbyte shall not be liable for any indirect, special, incidental, or consequential damages relating to or arising out of the subject matter of this Agreement or actions taken there under.

NO WARRANTY OF ANY KIND IS EXPRESSED OR IMPLIED. YOU USE Viperbyte AT YOUR OWN RISK. NETPLAY SOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. NOBODY WILL BE LIABLE FOR DATA LOSS, DAMAGES, LOSS OF PROFITS OR ANY OTHER KIND OF LOSS WHILE USING OR MISUSING THIS SOFTWARE.

The entire liability of NetPlay Software and your exclusive remedy shall not exceed the price paid for Viperbyte.

You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. Any such unauthorised use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

All rights not expressly granted here are reserved by NetPlay Software.

The terms of this license, as well as the appearance and design of Viperbyte are subjects of change in future versions of Viperbyte.

Installing and/or using Viperbyte signifies acceptance of these terms and conditions of the license.

If you do not agree with the terms of this license you must remove the Viperbyte files from your storage devices and cease to use the product.
