The Clonio Fair Use License is designed to keep Clonio source-available and free for individuals, students, and open source projects — while requiring commercial organizations that benefit from the software to contribute to its continued development.
- "Software" means the Clonio application source code, documentation, and associated files distributed under this license.
- "Commercial Use" means use of the Software in connection with any activity intended for or directed toward commercial advantage or monetary compensation. This includes, but is not limited to, use within a for-profit organization's development, testing, staging, QA, or demo environments.
- "Open Source Project" means a project whose source code is publicly available under an OSI-approved open source license.
- "Small Business" means an organization with annual gross revenue not exceeding €1,000,000 (one million euros) or its equivalent in local currency.
- "Annual Revenue" means the total gross revenue of the licensee and all affiliated entities for the most recently completed fiscal year.
Subject to the terms of this license, you are granted a non-exclusive, worldwide, non-transferable right to use, copy, modify, and distribute the Software, subject to the conditions below.
You may use the Software free of charge if any of the following apply:
- (a) You are an individual using the Software for personal, educational, or non-commercial purposes.
- (b) You are using the Software solely for an Open Source Project.
- (c) You are using the Software for evaluation or testing purposes for a period not exceeding 30 days.
If you engage in Commercial Use of the Software and none of the exemptions in Section 3 apply, you must obtain a paid license:

License fees are per organization (not per user, seat, or instance). One license covers all instances of the Software within the licensee's infrastructure.
The Software is designed to run within the licensee's own infrastructure. No data is transmitted to the licensor or any third party as part of normal operation. Licensees are solely responsible for the security and operation of their deployment.
The source code of the Software is made publicly available. You may view, fork, and modify the source code. However, distribution of modified versions must:
- (a) Include a copy of this license.
- (b) Clearly indicate that changes were made.
- (c) Not remove or alter any license notices.
You may not:
- (a) Offer the Software as a hosted or managed service to third parties (SaaS, PaaS, or similar) without a separate written agreement from the licensor.
- (b) Remove, alter, or obscure any licensing, copyright, or attribution notices.
- (c) Use the Software in any manner that violates applicable law.
THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT. IN NO EVENT SHALL THE AUTHORS OR COPYRIGHT HOLDERS BE LIABLE FOR ANY CLAIM, DAMAGES, OR OTHER LIABILITY, WHETHER IN AN ACTION OF CONTRACT, TORT, OR OTHERWISE, ARISING FROM, OUT OF, OR IN CONNECTION WITH THE SOFTWARE OR THE USE OR OTHER DEALINGS IN THE SOFTWARE.
This license terminates automatically if you fail to comply with its terms. Upon termination, you must cease all use of the Software and destroy all copies in your possession.
This license is governed by the laws of the Federal Republic of Germany.
