These Terms of Service ("Terms") govern your use of the Hefty personal AI assistant software and the hefty.bot website (collectively, the "Service") provided by Elite AI LLC ("we," "us," or "our").
By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Hefty is a personal AI assistant that runs on your computer. It helps you organize files, automate tasks, research information, and manage your work. Hefty processes your data locally on your device. You choose and configure your own AI provider to power Hefty's reasoning capabilities.
You must be at least 16 years old to use the Service. By using the Service, you represent that you meet this requirement.
If you create an account to access parts of the Service (such as downloads or support), you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Please notify us promptly at [email protected] if you suspect unauthorized access to your account.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Hefty software for your personal or internal business purposes.

Hefty may include open source software components, each governed by its own license. Nothing in these Terms restricts your rights under, or grants you rights that supersede, the terms of any applicable open source license.
Hefty is designed so that your conversations, files, and learned preferences are stored and processed locally on your device. We do not collect, access, or store this data. You retain full ownership and control of all data processed by Hefty on your machine.
You are responsible for selecting and configuring your AI provider. If you choose a cloud-based AI provider (such as OpenAI or Anthropic), your prompts are sent directly from your device to that provider using your own API key. Your use of any third-party AI provider is governed by that provider's own terms of service and privacy policy. We are not responsible for the data practices of third-party AI providers.
Our collection and use of information through the hefty.bot website and account services is described in our Privacy Policy. Please review it carefully.

We reserve the right to suspend or terminate your access to the Service if we reasonably believe you are violating these Terms.
The Service, including the Hefty software, website, documentation, branding, and all related intellectual property, is owned by Elite AI LLC and protected by copyright, trademark, and other intellectual property laws. These Terms do not transfer any ownership rights to you.
You retain all rights to the content you create, process, or store using Hefty. We claim no ownership over your data, files, conversations, or any output generated by Hefty on your device.
Hefty is currently in beta. This means:
Beta status does not limit our obligations under applicable law, but we ask for your understanding that the software is actively evolving.
Hefty may integrate with or connect to third-party services, plugins, and APIs. Your use of such third-party services is governed by their respective terms and policies. We are not responsible for the availability, accuracy, or practices of any third-party service.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION.
Hefty is an AI assistant. Its outputs - including suggestions, summaries, file operations, and automated actions - may be inaccurate, incomplete, or inappropriate. You are responsible for reviewing and verifying any actions Hefty takes on your behalf. Do not rely on Hefty for critical decisions without independent verification.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELITE AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY U.S. DOLLARS (US $50), WHICHEVER IS GREATER.
Because Hefty operates locally on your device and can perform actions such as reading, writing, and deleting files, you acknowledge that you are responsible for the supervision and consequences of actions performed by the software on your system. We strongly recommend maintaining regular backups of important data.
You agree to indemnify, defend, and hold harmless Elite AI LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
We may modify these Terms from time to time. When we make material changes, we will update the "Last Updated" date and, where appropriate, notify you through the Service or by email. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, please discontinue use of the Service.
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall first be addressed through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of such courts.
