1. Acceptance of Terms
By accessing or using any product or service provided by Btelo ("we", "us", or "our"), including btelo.com and its subdomains such as vibe-remote.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our products or services.
2. Description of Services
Btelo is a platform that develops and operates multiple software products. Current products include:
- btelo.com — the main platform and marketing site
- Vibe Remote (vibe-remote.com) — a remote management tool that allows you to control and manage computer sessions from your iPhone via a chat interface
- Additional products and services may be added to the platform over time
Each product may have its own additional terms. In the event of conflict between product-specific terms and these Terms, the product-specific terms apply.
3. Eligibility
You must be at least 18 years old to use our products and services. By using them, you represent that you meet this requirement.
4. Account and Credentials
You are responsible for maintaining the security of your account credentials, connector IDs, or any other identifiers issued to you. You are solely responsible for all activities that occur under your account. You must not share your credentials with others.
5. Acceptable Use
You agree to use our products only for lawful purposes. You must not:
- Use any product to access computers or systems without authorization
- Use any product for any illegal, harmful, or fraudulent activity
- Attempt to interfere with or disrupt any of our services or relay infrastructure
- Reverse engineer, decompile, or disassemble any part of our products or services
- Use any product to transmit malware, viruses, or harmful code
- Impersonate any person or entity or misrepresent your affiliation
6. Subscriptions and Payments
Some of our products offer free and paid subscription tiers. Where payments are processed through Apple's App Store:
- Payment is charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your Apple ID account settings
- Refunds are handled by Apple according to their refund policies
- We reserve the right to change subscription pricing with reasonable notice
7. Disclaimer of Warranties
ALL PRODUCTS AND SERVICES PROVIDED BY BTELO — INCLUDING BUT NOT LIMITED TO ANY iOS APP, COMMAND-LINE INTERFACE (CLI), RELAY SERVER (WHETHER CLOUD-HOSTED OR SELF-HOSTED), AGENT BINARY, WEBSITE, AND ANY OTHER SOFTWARE OR SERVICE — ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that any product or service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Your use of any of our products or services is entirely at your own risk.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BTELO, ITS AFFILIATES, OR ITS LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, GOODWILL, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF ANY OF OUR PRODUCTS OR SERVICES, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF ANY OF OUR PRODUCTS OR SERVICES SHALL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, THE ABOVE LIMITATIONS SHALL APPLY TO THE MAXIMUM EXTENT PERMITTED BY LAW.
9. Indemnification
You agree to indemnify, defend, and hold harmless Btelo from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of our products, your violation of these Terms, or your violation of any rights of a third party.
10. Your Data and Commands
You are solely responsible for any commands you send to your computer or other systems through our products. We are not responsible for any damage, data loss, or consequences resulting from commands executed via our products. You should exercise caution and ensure you understand the effects of any command before sending it.
11. Use at Your Own Risk — Computers, Data, and Third-Party Services
Our products are designed to help you manage and interact with your devices, data, and connected services. While we strive to implement strong security measures, you acknowledge and agree that:
- You are solely responsible for the security of your computer, files, data, and any credentials (including AI platform accounts and API keys) used in connection with our products
- We are not liable for any loss, corruption, or unauthorized access to your computer systems, files, data, AI platform accounts, API keys, or any other credentials
- You should take your own precautions to secure your devices, back up your data, and protect your credentials before using our products
- We make no guarantees regarding the prevention of unauthorized access to your systems or data
BY USING ANY BTELO PRODUCT, YOU ACCEPT FULL RESPONSIBILITY FOR ANY AND ALL CONSEQUENCES ARISING FROM THE USE OF SUCH PRODUCT, INCLUDING BUT NOT LIMITED TO DAMAGE TO COMPUTER SYSTEMS, LOSS OF DATA, COMPROMISE OF ACCOUNTS OR API KEYS, AND ANY OTHER LOSSES. WE SHALL NOT BE HELD LIABLE FOR ANY SUCH CONSEQUENCES UNDER ANY CIRCUMSTANCES.
12. Service Availability
We do not guarantee continuous, uninterrupted availability of any product or service. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any product or service at any time without prior notice or liability.
13. Intellectual Property
Btelo and all of its products, original content, features, and functionality are owned by Btelo. Our products are protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our products except as expressly permitted.
14. Termination
We may terminate or suspend your access to any product or service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the affected product ceases immediately. Provisions that by their nature should survive termination shall survive.
15. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes arising from these Terms or your use of our products shall be resolved in the courts of the jurisdiction where Btelo is located.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17. Entire Agreement
These Terms constitute the entire agreement between you and Btelo regarding the use of our products and services, superseding any prior agreements.
18. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated date. Your continued use of our products after any changes constitutes acceptance of the new Terms.
